Proof of a breach of your employment contract is another way to defeat a non-compete agreement. If your employer has not complied with the terms of the employment contract, they will probably not be able to force you to abide by a non-compete agreement. For example, if your employment contract requires that you receive a lump sum payment in the event of termination and your employer refuses to pay that amount, you should be able to invalidate the non-competition clause. The agreement should not be too broad and is generally difficult to implement if it takes more than two years.  However, Florida courts rarely refuse to impose a non-competition clause because of its length or geographic scope.
